POPULATION DEPENDENT EXCLUSIVITY
The franchiser, [Name of the franchiser], and the franchisee, [Name of the franchisee], as set forth in their franchise agreement on [Date of the agreement] and as witnessed by [Name of the witness], have agreed to the following additional terms and conditions:
Franchiser grants franchisee exclusivity of distributorship in and exclusive rights to the following described area: [Description of area], until such time that the population for the described area exceeds as determined by census. After such time that the census report reveals a surpassing of the aforementioned population requirements, the franchiser may grant another franchisee license.
